This is our “Terms of Service”, and it is a legally binding agreement made between you, whether personally or on behalf of an entity, and us. When we say “we”, “us”, and “our”, we mean the “SecurityBot Entities” which refers to SecurityBot LLC, its parents, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors; and, when we say “bot” or “services” it refers to our Discord bot itself and the “use” of either means to purchase, use or access the bot in any way. When we say “you” or “your,” we mean the individual or entity using the services. If you are accessing our bot on behalf of another individual or legal entity, you agree that you have the authority to bind that entity to these terms, and “you” and “your” will refer to that individual or entity. We also have a Privacy Policy that applies to your use of our bot and is incorporated, in full, into these Terms of Service.

Usage Areement

By accessing our services, the bot, you agree that you have read, understood, and agree to be bound by all of these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service and our Privacy Policy, you may not access or otherwise use the bot.

You are responsible for regularly checking these Terms of Service. The Terms of Service will be provided to you as part of purchase of a subscription and the Terms of Service can be found here and accessible from our Discord Server.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service, from time to time, without providing specific notice of each such change to you personally. We will alert you about any changes by updating the “Last updated” date of these Terms of Service and posting about the occurrence of the update on our Discord Server and SecurityBotNFT on Twitter. You agree that the preceding is sufficient notice of any change to the Terms of Service and waive any right to notice in any form other than the preceding. Additionally, we reserve the right to post and implement additional policies and documents from time to time, these are hereby expressly incorporated into these Terms of Service as of the date they become publicly available to users of the bot. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Service by your continued use of the bot after the date such revised Terms of Service are posted.

We have the right to suspend or terminate your account and refuse any and all current or future use of the bot (or any portion thereof) at our own discretion.

Intended Age

The bot is intended for users who are at least 13 years of age and meet the minimum age of digital consent in your jurisdiction. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the bot. If you are old enough to access our Bot in your jurisdiction, but not old enough to have authority to consent to our Terms of Service, your parent or guardian must agree to our Terms of Service on your behalf. Please ask your parent or guardian to read these terms with you. If you are a parent or legal guardian, and you allow your teenager to use the both, then these Terms of Service also apply to you and you're responsible for your teenager's activity on the services.

Affiliation

The bot is not affiliated with, supported by, or made by Discord Inc. Any direct connection to Discord or any of its trademark objects is purely coincidental. We do not claim, and do not have to have, the copyright ownership of, or licensing rights to, any of Discord's assets, trademarks, or other intellectual property.

Fees and Payment

You are required to purchase a subscription to use our services. You agree to pay all charges or fees at the price then in effect for your purchase. Upon our reception of payment, you will receive access to our services for the length of time determined by our pricing plans. Sales tax may be added to the price of purchases as deemed required by us. We may change our pricing at any time. All purchased subscriptions are nonrefundable.

We accept payments made through the Stripe payment processor as well as the following other form(s) of payment:

• ADA

Unless purchased through the Stripe payment processor, subscriptions are not automatically recurring. You agree that you will lose access to our services after the length of time determined by our pricing plans. In order to regain access to our services, you will have to purchase a new subscription. We are not responsible for any data that may be lost if a subscription ends before a new one is purchased.

A subscription is purchased for a single Discord guild (“Discord Server”) and may be transferred to a new Discord Server by using the “Contact Us” information below to inform us of your desired transfer. You are limited to one (1) per subscription purchase.

We also reserve the right to refuse any subscription purchase. The benefits associated with our subscriptions are subject to change in any way or form, even while a subscription is still ongoing.

Coupons and Promotions

Coupons may only be used to purchase subscriptions. Coupons may not be exchanged, refunded, transferred or converted by you and are valid only for the purpose of you purchasing a subscription for our services. The terms of each coupon are stated therein, if a coupon does not state how many times it can be used and/or does not state when it will expire then such coupon will only be valid for one (1) use and will expire within thirty (30) days of issuance, regardless of who it is issued to.

Prohibited Activities

You may not access or use the bot for any purpose other than that for which we make the bot available. The bot may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the bot you agree not to:

• Trick, defraud, or mislead us or anyone else, including any attempt to learn account information such as user passwords or other stored data.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the bot.
• Make improper use of our support services or submit false reports of abuse or misconduct.
• Use any information obtained through the bot in order to harass, abuse, or harm another person.
• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the bot to you.
• Unless expressly permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software or data comprising or in any way making up a part of the bot.
• Use any type of unauthorized automation within Discord.

The Services are Available “AS-IS”

Your access to and use of the services is at your own risk. You understand and agree that the services are provided to you on an “AS IS” and “AS AVAILABLE” basis. Without limiting the foregoing, to the maximum extent permitted under applicable law, THE SECURITYBOT ENTITIES DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. The SecurityBot Entities make no warranty or representation and disclaim all responsibility and liability for: (i) any harm to your computer system, loss of data, or other harm that results from your access to or use of the services or any interruption in the services regardless of the cause of the interruption; (ii) the deletion of, or the failure to store or to transmit, any data and other communications maintained by the services; and (iii) whether the services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from the SecurityBot Entities, will create any warranty or representation not expressly made herein.

Limitation of Liability

THE SECURITYBOT ENTITIES WILL NOT BE LIABLE, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOST REVENUES, LOST SAVINGS, LOST BUSINESS OPPORTUNITY, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE SECURITYBOT ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY PROVIDED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

BESIDES THE TYPES OF LIABILITY WE CANNOT LIMIT BY LAW, THE SECURITYBOT ENTITIES LIMITS OUR LIABILITY TO YOU TO THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE THREE MONTHS BEFORE YOU FIRST ASSERT A CLAIM OR (B) FORTY DOLLARS ($40) (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY).

THE SECURITY BOT ENTITIES ARE NOT LIABLE FOR THE CONDUCT OR CONTENT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF OUR SERVICES.

Settling Disputes

We are confident that most disputes can be resolved informally, so if you have an issue with our services, please consult with us first. Before pursuing formal legal action, you agree to try to resolve a dispute with us informally by sending notice to through our Discord Server or send a message to SecurityBotNFT on Twitter.

Idemnity

You will indemnify and hold the SecurityBot Entities harmless from and against any claims, liabilities, damages, and costs (including reasonable legal and accounting fees) related to (a) your access to or use of our services, (b) your content, or (c) your violation of these terms.

If you are using the services on behalf of third party, such as a business or legal entity, you will indemnify and hold the SecurityBot Entities harmless from and against any of such business or legal entity's claims, liabilities, damages, and costs (including reasonable legal and accounting fees) related to (a) your access to or use of our services, (b) your content, or (c) your violation of these terms.

Additional Terms

These Terms of Service cover the entire agreement between you and us for your use of our services.

If you fail to follow these Terms of Service and we don't immediately act, that doesn't mean we're giving up any of our legal rights (such as acting in the future). If any part of these terms ends up being invalid or unenforceable based on a decision by any court or competent authority, the rest of these terms will not be affected. You may not assign these terms to anyone else without our written consent. We may assign our rights to any of our affiliates or subsidiaries, or to any successor in interest of any business associated with our services.

These Terms of Service shall survive the deactivation or termination of your subscription.
